As part of our accreditation we have signed up to the Conveyancing Quality Scheme Charter which tells you exactly what you can expect from us:

The process

As soon as you decide to put your house on the market or have an offer accepted on a property you should contact us so that we can get the administrative matters under way. We can then ensure that we progress your property matter as soon as possible.  We will need to know several details including:

  • Evidence of identification
  • The price of the property
  • Any factors or time-scales you need us to work to
  • How you are planning to pay for the property
  • If you are applying for a mortgage or have a mortgage to redeem
  • Whether you plan to carry out any work on the property
  • If you are acting for someone else

Buying a Property

Stage One: You have agreed a purchase price

We will:

  • Write to the seller’s Solicitor to request the draft contract papers
  • Review the contract papers when received
  • Commission searches from Local Authority, Environmental, Water & Drainage and any other pertinent searches against the property
  • On receipt of all the commissioned searches prepare a report on title relating to all legal matters arising for your consideration and comment
  • Raise any enquiries we have regarding the property and present the responses to you
  • Receive and deal with any specific requirements with your mortgage offer (if any)
  • Arrange a meeting to discuss paperwork for signature
  • Agree a date for exchange and completion with you and the seller’s Solicitor

Stage Two: Exchange of Contracts

  • Call you to confirm that we have exchanged for completion
  • Transfer the deposit to the Seller’s Solicitor
  • Draft Transfer deed and arrange for you to sign the same in readiness for completion
  • Prepare a completion statement for your approval and obtain the balance of funds from you needed for completion
  • Carry out pre-completion searches

Stage Three: Completion

We will:

  • Transfer the balance of the monies over to the seller’s Solicitor for completion
  • Call you to confirm completion and explain the arrangements for you to pick up the keys
  • Complete the Stamp Duty Land Tax return and pay any Stamp Duty due.
  • Put in the application to register the property with the Land Registry
  • Send you a copy of your deeds confirming that the property has been registered in your name
  • Send any necessary information to the mortgage company as appropriate
  • Place your title deeds in our strong room for safe keeping

Selling Your Property

Stage One: You have agreed a sale price

We will:

  • Obtain your title deeds or apply to the Land Registry for up to date copies of the title of your property
  • Ask you to complete property information forms
  • Prepare and send out the draft contract papers to the buyer’s Solicitor
  • Request an up to date redemption figure for information purposes from your mortgage company
  • Discuss with you any enquiries raised by the buyer’s Solicitor in respect of property and reply accordingly
  • Arrange a meeting with you to discuss the paperwork for signature in readiness for exchange of contracts
  • Agree a date for exchange and completion with you and your buyers Solicitor

Stage Two: Exchange of Contracts

We Will:

  • Call you to confirm that we have exchanged for completion
  • Receive the deposit from the buyer’s Solicitor
  • Approve the draft transfer deed from the buyer’s Solicitor and arrange for you to sign the same in readiness for completion
  • Obtain a final redemption figure from your mortgage company (if relevant)
  • Prepare a completion statement for your approval and obtain the balance of funds from you (if relevant)

Stage Three: Completion

We Will:

  • Receive the balance of the monies from the buyer’s Solicitor
  • Call you to confirm completion and contact the estate agent to confirm that they can release the keys to the Buyers
  • Pay off your mortgage and write to your mortgage company to confirm settlement of the account
  • Forward the transfer deed and all other deeds and documents relating to the property to the buyers Solicitor
  • Pay the estate agents sale commission if appropriate
  • Forward the balance of monies to you

Costs

We will quote you a cost on request.  Please remember that there are a number of additional expenses such as Stamp Duty, Land Registry, VAT and several search fees including those with the Local Authority to ascertain any planning issues that may affect the property.  Other searches may include flooding, contaminated land and mining subsidence.
